Summary: Spot on
Comment: Judge Napolitano is spot on in his assessment of the current state of affairs regarding the federal government and the Constitution. His clear writing style enables him to explain constitutional law in a manner that everyone can understand. He is able to show how the form of government enshrined in our Constitution is intended to work, and effectively contrast that with how our government is actually working. His examples make one wonder if our officials who have sworn to protect and defend the Constitution have ever bothered reading it.

The author comes across as "party neutral," and neither "liberal" nor "conservative" -- merely sensible.

Highly recommended reading.

Summary: Wake Up People!
Comment: A very sobering look at the complacency and/or apathy of many Americans concerning hazardous and often invasive legislation that undermines our freedom with more needless, pointless restrictions and increased governmental control.

Summary: Preaching to the Choir At Best
Comment: This book is an easy-breezy reading experience written by former New Jersey Superior Court Judge Andrew Napolitano. The book's strong point is that it is well documented and thorough without being verbose. And so it is a pretty good list of the many outrages perpetrated by today's modern nanny state.

The thesis for Napolitano is that the "boiling frog" syndrome is making short work of demolishing our privacy, liberty and democratic politics [p.120].

With that said though, the Judge doesn't leave much room for optimism or hope that this sad condition will change once the current administration in Washington (whom Napolitano trashes with undisguised anger) leaves office and the current crop of judges retire. What Napolitano's book does remind me of is the sermons of some religious fundies who think that every problem in this world will just go away if we all just quit being so evil and stupid and "come back to Jesus". Only Napolitano's faith is in old fashioned constitutional democracy as laid forth in the original unamended U.S. Constitution. Fat chance of that happening though Judge.

Napolitano's reverence for the Constitution as it was "meant" to be is laudable but that is where his scholarship and historical insight seems to fail him. He should read Woody Holton's Unruly Americans and the Origins of the Constitution. Putting all your faith in a piece of paper to keep you free is just as foolish in a political context as it is in a religious or spiritual one. A point that the Judge doesn't seem to get.

For reasons both noble and base the powers-that-be just keep chip, chip, chipping away our liberties and we feckless sheep just keep letting them too, says the Judge.

A surprising fact for me at least was to discover that Napolitano is the "Senior Judicial Analyst" for the FOX News Channel and the endorsement blurbs on the back of the dust cover come from Rush Limbaugh, Sean Hannity, and Bill O'Reilly, which given the Judge's harsh and uncomplimentary view of the Bush administration I found quite remarkable.


However I can only recommend this book to people who still have a lot faith in the American political process and legal system. For those with a more skeptical view of law, society, and politics, I'd say just keep looking.

Summary: A NATION OF SHEEP
Comment: a very important book but what troubles me is the use of the SAME TITLE -
"A NATION OF SHEEP" written by William J. Lederer that describes the same situation more than 50 years ago. Are we going to learn someday?

Comment: A good book. The Judge has many good points and backs them up with cases to demonstrate his arguments. I highly recommend his book.

In A NATION OF SHEEP, Judge Andrew P. Napolitano frankly discusses how the federal government has circumvented the Constitution and is systematically dismantling the rights and freedoms that are the foundation of American democracy.  He challenges Americans to recognize that they are being led down a very dangerous path and that the cost of following without challenge is the loss of the basic freedoms that facilitate our pursuit of happiness and that define us as a nation.

Judge Napolitano reminds readers what America is all about, that the purpose of government is to protect freedom, and freedom is the ability to follow your own free will and not the will of government bureaucrats.  He asks the simple question, which are YOU, a sheep or a wolf?  Do you blindly follow behind where you are led, or do you challenge the government at every pass, forcing it to make decisions that will protect our freedoms?

Judge Napolitano asks the questions that no one else will, challenging readers to rethink why they are blindly following a government that has only its own interests in mind.  He asks:

  • Why is the government using the war on terror as an excuse to sidestep the Constitution?
  • Why are Americans not challenging and questioning the government as it continues to limit more and more of our freedoms?
  • What part of "Congress shall make no law..." does the government not understand when it criminalizes speech?
  • Whatever happened to our inalienable rights to life, liberty, and the pursuit of happiness that are proclaimed in the Declaration of Independence, guaranteed by the Constitution, yet ignored by the governments elected to protect them?
  • Why does every public office holder swear allegiance to the Constitution, yet very few follow it?
  • Don't we have rights that are guaranteed and cannot be taken from us?
