July 18 (Bloomberg) -- Germany's highest court today nullified a law that implements the European Union arrest warrant, triggering the release of a Syrian-German man suspected of being a key member of the al-Qaeda terrorist organization.
German legislators ``didn't use the leeway of the European arrest warrant'' to better protect the basic rights of German suspects, Germany's Federal Constitutional Court said today in a statement e-mailed to news organizations. Without a new law, ``the extradition of a German citizen isn't possible.''
Today's ruling affects Mamoun Darkazanli, who has been in custody pending extradition to Spain since Oct. 15, 2004. He is accused by Spain of being ``one of the key figures of the al-Qaeda terrorist network'' who has provided logistical and financial support for al-Qaeda since 1997 in Spain, Germany and the U.K., the Hamburg Higher Regional Court said on Nov. 24.
