Why would a cop, or anyone else, start shooting at a snake in a tree?
Cop's Shots at Snake May Have Killed Boy
NOBLE, Okla. (Aug. 4) - A stray bullet fired by a police officer trying to shoot a snake hit and killed a 5-year-old boy fishing at a nearby pond, officials said.
It doesn't even say whether the snake was poisonous or not, but, even if it was, shooting at it in a tree is more dangerous than the snake would be.

Rule # 4. Be Sure Of Your Target And What's Beyond It.
The police dept in Noble, Oklahoma needs to have a teen who has passed the NRA Basic Firearm Training Course ride in each one of their police cruisers to help the ill trained police officers.

I agree - rule #1 make sure of your target.
Do you lot realise that over here it is illegal to kill snakes? And we have the most deadly land snakes in the world:p (ps they "allow" you to kill the snake if it has already bitten you;))

That is exactly why police are forbidden to fire "warning shots". And why they do not shoot to wound, or shoot the gun out of the bad guys hand. Too easy to miss when you're aiming for something large like the chest area, let alone smaller targets like legs, hands, etc.
This guy deserves to be charged with some form of negligent/accidental homicide/manslaughter.... This is outrageous behavior on his part.

It's illegal to kill snakes in Australia? Don't you have a zillion different varieties of poisonous snakes that can kill you in seconds?
Over here, where there is no law against killing snakes, there are only four different varieties of poisonous snakes. Most of the snake bites are the result of drunkeness or stupidity (on the part of the human that is), and are rarely fatal.
Still, I have little sympathy with people who have to kill every snake they see, poisonous or not.
